KindMind Center ("KindMind," "we," "us," or "our") is a Maryland-licensed mental health practice operated by Empowerment Therapy Services of Maryland, LLC (ETSMD), located at 3655 A Old Court Rd, Suite 1, Baltimore, MD 21208. We provide telehealth therapy, medication management, psychiatric rehabilitation services, and therapeutic mentoring to clients across Maryland.

2. What this policy covers

This Privacy Policy describes how the KindMind Center website (thekindmindcenter.com) collects and handles information from visitors and prospective clients. It applies to data you provide through this website only.

This is separate from our HIPAA Notice of Privacy Practices.Once you become a client, the privacy of your health information is governed by our Client Orientation Handbook & Service Policy Agreement, which contains our full HIPAA Notice of Privacy Practices and 42 CFR Part 2 protections.

3. Information we collect

We collect different categories of information depending on how you interact with our site:

Information you provide voluntarily

Get Started intake form.Name, phone, email, insurance information, insurance policy/member ID, the type of care you're looking for, and anything else you choose to share. Some of this is Protected Health Information (PHI).

PRP Referral form (for clinicians).Client demographic and clinical details, including diagnoses, plus referring therapist contact and license information. This is PHI submitted by a licensed clinician on behalf of a client.

Career inquiries.Information you choose to send when applying for a role with us.

Phone, email, or text communications.Anything you choose to share with us through these channels.

Information collected automatically

Standard web log information: IP address, browser type, device type, pages viewed, referring website, and approximate location.

Limited analytics data about how visitors use the site, used in aggregated form to help us improve the experience.

4. How we use your information

We use the information we collect to:

Respond to your inquiry and connect you with the appropriate clinician.

Schedule appointments and coordinate care.

Verify insurance benefits and eligibility.

Communicate with you about your care, in the way you've indicated you prefer (phone, text, or email).

Operate, maintain, and improve our website.

Comply with legal, regulatory, and accreditation requirements.

We do not sell your information. We do not use your information for third-party advertising. We do not share your information for purposes unrelated to your care or our operations, except as required by law.

5. HIPAA & Protected Health Information

KindMind Center is a HIPAA-covered entity. Protected Health Information (PHI) you share with us — including through the Get Started intake form, the PRP Referral form, or once you become a client — is protected under:

Forms on this website that collect PHI are transmitted and stored on HIPAA-compliant infrastructure. KindMind maintains Business Associate Agreements (BAAs) with the vendors who help us deliver these services, including our website host, our intake form provider, our electronic signature provider, and our telehealth platform.

6. How we share information

We share information only as needed to provide your care and only as the law permits. Specifically:

With our team.Members of the KindMind care team who need information to coordinate your treatment.

With our HIPAA-covered service providers.Vendors with signed Business Associate Agreements who help us provide care (telehealth platform, EHR, intake forms, e-signature, billing).

With your insurance.Only as needed for benefit verification, prior authorization, and claims, with your authorization.

As required or permitted by law.For example, mandated reporting of suspected child abuse, court orders, or imminent risk of harm.

We do not share, rent, or sell your information to marketers, data brokers, advertising networks, or any other third parties for their own purposes.

7. Cookies & analytics

Our website uses a small number of cookies and similar technologies to help the site function and to understand how it's used in aggregate. These do not capture PHI.

Most web browsers let you control cookies through their settings — you can refuse cookies, delete them, or be notified when one is set. Disabling cookies may affect some site functionality.

We do not use third-party advertising cookies or behavioral retargeting.

8. Security

We take reasonable administrative, technical, and physical safeguards to protect your information, including:

HTTPS encryption for all traffic to and from our website.

HIPAA-compliant hosting and form-handling infrastructure for any page that collects PHI.

Access controls so staff only see information they need to do their work.

Regular review of our security and privacy practices.

No system is perfectly secure. If we become aware of a breach involving your information, we will notify you in accordance with HIPAA Breach Notification rules and applicable state law.

9. Your rights & choices

Ask us to correct or delete information.Subject to legal and clinical record-retention requirements.

Withdraw consent.You can withdraw consent for communications at any time. Some legally required communications about active care may continue.

File a complaint.If you believe your privacy rights have been violated, you can contact us directly (see Section 13), or file with the U.S. Department of Health and Human Services Office for Civil Rights at [email protected] 1-800-368-1019.

Maryland residents and others may have additional rights under state and federal law.

10. Children's privacy

Our website is not designed for direct use by children under 13. For child and teen clients, we expect a parent or legal guardian to provide consent and complete the intake. If you believe a child has submitted information through our forms without parental consent, please contact us so we can remove it.

11. Third-party links

Our website may link to third-party services (for example, our patient portal hosted by Qualifacts InSync, our scheduling tool, or our e-signature provider). These services have their own privacy policies, which we encourage you to review. We are not responsible for the privacy practices of third-party sites we don't control.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we'll change the "Last updated" date at the top of the page. Material changes will be communicated through the website. Your continued use of the site after an update means you accept the revised policy.
